P.F. Chang’s China Bistro Inc. had an undisclosed settlement approved with a certified collective of servers across 30 states to resolve allegations the restaurateur violated federal labor laws.
The settlement agreement the parties proposed in May concerns allegations that P.F. Chang’s violated the Federal Labor Standards Act by requiring its servers to perform “side work” for a tip-credited wage. Judge Anita B. Brody preliminarily approved the agreement on Thursday in the US District Court for the Eastern District of Pennsylvania, which will also voluntarily dismiss the servers’ Maryland and Pennsylvania-based wage claims.
