A co-founder of a Mexican freight hauling company will have to face a fraud lawsuit in Texas because he “substantially invoked the litigation process” there, a Texas appeals court ruled.
Logicorp Mexico SA de CV’s claims can go forward because Jorge Andrade waived his right to enforce the forum selection clause in the company’s bylaws. The docket shows that prior to filing a motion to dismiss, Andrade also filed summary judgment motions and a motion to quash the deposition of another shareholder, therefore the Texas Court of Appeals, Thirteenth District, reversed the trial court’s judgment.
