An attorney accused by two of his former partners at Otterbourg PC of rummaging through their personal data on the firm’s network defeated their invasion-of-privacy lawsuit.
The aggrieved attorneys’ intrusion-upon-seclusion claim failed because that cause of action isn’t recognized under New York law, Judge Sarah F. Russell of the US District Court for the District of Connecticut said Feb. 27.
Russell granted defendant James M. Cretella’s motion to dismiss the lawsuit, but gave plaintiffs Richard Stehl and Richard D. Haddad—senior partners at the firm—leave to replead a claim of intentional infliction of emotional distress.
