Organic Protein Powder Wins $10 Million, Injunction for IP Claim

Organic protein powder manufacturer Orgain Inc. scored a $10 million jury verdict and a permanent injunction against a rival company found liable of copying Orgain’s distinctive green containers.

“The Court concludes that Orgain has suffered irreparable injury for which monetary damages are inadequate,” Judge Josephine L. Staton, of the US District Court for the Central District of California said in a post-trial decision on equitable relief Wednesday. Staton also enjoined defendant Iovate Health Sciences International Inc. and Iovate Health Sciences USA from using the infringing trade dress.
