Organic Food Seller’s $7 Million Settlement Gets Final Approval

An organic food supplier and a Peruvian exporter can move forward and resolve class action allegations about their liability in Daily Harvest’s recalled “French Lentil + Leek Crumble” meals.

Organic food importer Smirk’s Ltd. and Peru-based exporter Molinos Asociados SAC received final approval on their $7.6 million settlement from the US District Court for the Southern District of New York on Tuesday, Judge Denise L. Cote said in a final judgment. The settlement will resolve all class claims from Breeanne Buckley Peni, who alleged the recalled meal left her hospitalized with gastrointestinal illness.
