Two California-based web users can continue litigating various privacy claims against data broker OpenX Technologies Inc., a federal district court said.
The web users’ proposed class action has standing to pursue claims under the California Invasion of Privacy Act and Electronic Communications Privacy Act, but the plaintiffs need to amend their complaint to exclude a denied unjust enrichment claim, the US District Court for the Northern District of California ruled Tuesday.
