Omegle Shakes Child Sex Trafficking Claims in Eleventh Circuit

Omegle.com LLC shook claims from parents who alleged their daughter was sexually abused on the website, with judges finding they didn’t plausibly allege the video-chatting platform knew it possessed child pornography or met criminal liability standards for sex trafficking.

The burden of proof is higher for civil plaintiffs who bring sex trafficking claims against internet services than other kinds of defendants, a federal panel wrote. The “actual knowledge” standard required for civil cases by the 2018 Fight Online Sex Trafficking Act is also used for criminal allegations of sex trafficking.
