Ohio Workers’ Comp Board Lacks Required Expertise, Says Lawsuit

The members of an Ohio commission that hears workers’ compensation disputes don’t have the experience required by law to serve, a lawsuit alleges.

The suit, filed Monday, zeroes in on a state law that says the three members of the Ohio Industrial Commission—which also hears disputes over total disability and workplace safety—“shall have six or more years of recognized expertise in the field of workers’ compensation.” None of the current commissioners, all appointed by Gov. Mike DeWine (R), have the requisite experience, according to the lawsuit filed in Franklin County Common Pleas Court.
