Ohio Sued Over Restrictions on Local Flavored Tobacco Bans (2)

Ohio’s three largest cities are among the 14 suing the state over a yet-to-be-enacted state law that would bar municipalities from enacting restrictions on tobacco sales.

The law—passed as part of the state’s biennial budget—runs afoul of the Ohio Constitution’s home-rule provision giving municipalities latitude to govern and police themselves, states the lawsuit, filed Tuesday in Franklin County Common Pleas Court.

Columbus, Cleveland, Cincinnati, and 11 others with tobacco restrictions on the books allege the state is illegally meddling in their ability to regulate dangerous products that are increasingly being used by minors.
