A police investigator in Ohio must face a civil rights suit by a man who spent 20 years in prison for a rape conviction that was based on bogus evidence, the Sixth Circuit said.
Roger D. Gillispie was released from prison after Ohio courts vacated his convictions, finding meritorious his claims of failure to disclose exculpatory evidence and actual innocence.
Gillispie then sued Matthew S. Moore, a Miami Township, Ohio, investigator. He alleges Moore suppressed exculpatory evidence, used an unduly suggestive photo lineup, fabricated inculpatory evidence, assisted in maliciously prosecuting him, and destroyed exculpatory evidence.
