Ohio Justices Say Dismissed Suits Can Be Re-Filed Multiple Times

The Ohio Supreme Court on Wednesday said a state law allowing litigants to re-file a lawsuit if a judge dismisses it for any reason other than the merits aren’t limited to doing so just once.

A litigant, once a lawsuit is tossed, may re-file within either one year or before the statute of limitations runs out, whichever comes later, Justice R. Michael DeWine wrote for the majority.

There’s nothing in the “saving statute” that bars a litigant from re-filing twice, DeWine said.
