The Ohio Supreme Court on Tuesday said a Cleveland-area appeals court erred when it secretly deliberated and issued a full-court decision in a years-old case to affect the outcome of a separate matter involving a man convicted in a drive-by shooting.
But the justices also said the case, which stems from the nine-year sentence the man is serving, doesn’t need a fresh appellate review.
