An Ohio man can’t sue a hospital for damages based on its allegedly negligent failure to give him medical records related to care it provided to his mother while pregnant with him.
The state doesn’t recognize a cause of action for negligently failing to produce medical records, and the hospital had no statutory duty to give Jahmir Frank the documents, the Ohio Court of Appeals, First District, said.
The decision is the latest in Frank’s long-running dispute against various medical providers whose alleged negligence before and during his birth allegedly caused or contributed to a permanent brain injury.
