A lawsuit seeking refunds of tuition paid by New York University students when the school moved to online classes during the Covid-19 pandemic shouldn’t move forward as a class action, a magistrate judge said.
The suit didn’t establish predominance of a class under the Federal Rules of Civil Procedure, US Magistrate Judge Sarah L. Cave of the US District Court for the Southern District of New York said in a Dec. 6 report and recommendation that the class motion be denied. Parties have 14 days to file objections, Cave said.
