NYU Langone Judge Wrongly Set Aside Jury’s Retaliation Verdict

Evidence backed a jury finding that NYU Langone entities retaliated against a female rheumatologist for complaining about gender bias, the Second Circuit ruled Wednesday.

The ruling reinstates a $700,000 award because a lower court failed to view evidence in the light most favorable to the doctor when it granted a motion for judgment notwithstanding the jury verdict by the hospital system and one of its site directors, a unanimous appeals panel said. The panel also revived for trial the doctor’s retaliation claim against her former supervisor.
