NYU Brings Appellate Challenge to City Restrictions On Dorms

Judges on New York State’s intermediate appellate court Thursday questioned New York City zoning regulations barring college classrooms and student dormitories from a busy stretch of lower Manhattan after New York University argued the provisions are unlawful.

In a facial challenge, NYU is seeking a permanent injunction against the regulations. The university claims the zoning rules constrain how it uses its property and is appealing a New York State trial court’s 2023 decision dismissing its lawsuit against the city that argued the zoning rules violate the state constitution and case law.
