NYU Beats Class Certification, Sheds Covid Fee-Refund Lawsuit

New York University shed a suit alleging it didn’t refund student fees when classes went online in Spring 2020 because of Covid-19, after a federal court in New York deemed the lead plaintiff and her attorneys inadequate to represent the proposed class.

Because the case can’t be maintained as a class action—and certainly not by plaintiff Nelcy Garcia De León—the lone basis for federal jurisdiction disappears, Judge Colleen McMahon of the US District Court for the Southern District of New York said. McMahon dismissed the matter without prejudice Wednesday.
