New York Mercantile Exchange Inc. won’t face a claim by funds holding long positions in emissions offset futures that the exchange failed to enforce its delivery standards for the credits, a federal court ruled.
The funds’ other claims against Nymex and its parent CME Group Inc., including for breach of contract and for wrongfully interfering with a contract, are also dismissed and can be refiled in state court, the US District Court for the Southern District of New York said.
