NYC Transit Agency Must Face Disability Discrimination Claims

New York City’s Metropolitan Transit Authority failed to shed claims that it discriminates against disabled riders who use its paratransit service by failing to offer them the same discounts as those available to fixed-route transit riders.

The New York Supreme Court First Appellate Department rejected MTA’s argument that the claims are preempted by federal law. Judges agreed with plaintiffs—disabled riders who use the Access-A-Ride service—that MTA “would be acting in harmony” with both the New York City Human Rights Law and the federal Americans with Disabilities Act if it offers the same discounts for paratransit.
