NYC Sheriff Barred From Warrantless Hemp Business Searches (1)

New York’s cannabis agency and the New York City Sheriff’s Office are prohibited from conducting warrantless searches and seizures of licensed hemp stores after a state judge on Monday found their raids were likely unconstitutional.

Four businesses licensed to sell hemp but not cannabis are “highly likely to establish” their Fourth Amendment rights were violated when the sheriff’s office searched their businesses and seized their products, Albany County Supreme Court Justice Thomas Marcelle wrote in his decision. He ordered law enforcement to return any seized products to the businesses and issued a preliminary injunction against warrantless searches.
