NYC Housing Authority Must Face Worker Suit Over Covid-19 Leave

A father who worked as a contract specification writer at the New York City Housing Authority can sue the agency for denying him leave during the early days of the Covid-19 pandemic after his sons’ schools closed.

Joel Sosa’s lawsuit alleges that NYCHA was his primary employer, the US District Court for the Southern District of New York said. That’s necessary for Sosa to state a plausible claim under the Family and Medical Leave Act because that statute only requires a primary employer to provide a worker with family or medical leave, the court said.
