Nassau County can’t enforce its settlement with an employee alleging discrimination because her refusal to sign a confidentiality and non-disparagement form attached to the settlement pact meant the agreement never took effect, a federal judge ruled.
That was so even though settlements are generally binding under New York law once agreement is reached on all material terms, and the county and the employee agreed to end her case for payment of “a sum certain, an exchange of releases,” and a confidentiality/non-disclosure agreement, the US District Court for the Eastern District of New York said.
