NY Top Court Says 2022 Injured Workers Law Applies to Live Cases

New York’s highest court ruled on Thursday that a state law allowing injured workers to challenge Workers’ Compensation Board decisions in court can apply to cases filed before the law was enacted.

The Court of Appeals rejected Monadnock Construction’s argument that allowing an injured employee to challenge a board decision would be an incorrect retroactive application of the state law that took effect in December 2022. The company pressed the court to dismiss a lawsuit brought by Waldy Quinones Garcia, who claims he sustained injuries to his neck and lower back in 2020 while working at a construction site.
