NY Top Court May Get Leon Black, Alexander Brothers Cases (1)

A pair of sexual assault cases against Apollo Global Management Inc. co-founder Leon Black and a trio of luxury real estate broker brothers raise state law issues that are best suited for the New York Court of Appeals, Second Circuit judges said Wednesday.

The state Court of Appeals could provide some clarity on whether two state laws that created separate revival windows for sexual assault claims preempt the revival window in the city’s Victims of Gender-Motivated Violence Protection Law, a broad civil rights statute for survivors of gender-based violence, Judge Raymond J. Lohier Jr. said during oral arguments.
