NY Sheds Suit Over Ammunition Sales, Rifle License Rules

New York firearms sellers can’t move forward with claims that the state’s requirements for ammunition sales and semiautomatic rifle licenses unconstitutionally interfere with their businesses, a federal court said.

The sellers didn’t plausibly allege provisions requiring background checks for ammunition sales and licenses for buyers of semiautomatic rifles violate their Second Amendment rights, which are ancillary to those of the buyers, the US District Court for the Northern District of New York said Tuesday. These laws didn’t “meaningfully constrain” the Second Amendment right to own and carry firearms, Judge Brenda K. Sannes said as she dismissed the suit.
