A Western New York middle school is blocked from excluding a student for failing to receive a vaccine to prevent the bacterial infections tetanus, diphtheria, and pertussis, and federal district judge ruled.

The child’s parents, Alicia and Thomas Colella—who sued on behalf of their children A.C. and G.C.—are likely to succeed on the merits of their state-law claim against the Starpoint Central School District, Judge John L. Sinatra of the US District Court for the Western District of New York held April 25.
