NY Judges Question Viability of Tax on Remote Work in Modern Age

A New York appeals court during oral arguments Monday indicated it was open to overturning the state’s strict tax rules for remote work performed during the pandemic, by questioning the state’s assertion that such telework arrangements were done out of convenience.

Justice Christine Clark, of the New York Supreme Court, Appellate Division, Third Department, pushed back on the state’s argument that it was right to tax the income of a Cardozo Law School professor for work he performed from his Connecticut home when public health restrictions prevented him from accessing classrooms in New York City.
