New York Presbyterian Brooklyn Methodist Hospital can’t be compelled to reinstate a recent medical school graduate to its pediatric residency program, a state appeals court said in reversing an order requiring it to do so.
Under New York law, Walid Khass should have challenged the hospital’s withdrawal of its residency commitment through an administrative procedure designed for doctors to contest the loss of their medical staff privileges before filing the lawsuit, the New York Supreme Court Appellate Division said.
