A Second Circuit panel on Thursday upheld New York’s law allowing the state to sue firearm makers and sellers for gun violence.
The court rebuffed arguments from gun manufacturers and advocacy groups that said the state’s gun law is preempted by the federal Protection of Lawful Commerce in Arms Act, which is intended to protect them from liability when someone uses their products to commit a crime or injure someone.
