New York’s cannabis regulations are not preempted by federal law banning sale, use, or transportation of the substance, an upstate appellate court ruled Thursday.
“We find that no such conflict exists,” Associate Justice Lisa M. Fisher of the New York Supreme Court Third Appellate Department wrote as it modified a lower court’s order to turn it into a declaratory judgment. The ruling affirms the lower court order dismissing a lawsuit from anti-cannabis organizations.
