A New York court system requirement that senior and associate clerks file financial disclosures for 2023 is arbitrary and capricious, the court clerk’s union says in a petition seeking to enjoin the court system from enforcing it.
The New York State Court Clerks Association’s petition filed Thursday argues those clerks should be exempt from the disclosure requirements because they don’t negotiate contracts, authorize expenditures, oversee public funds, or engage in policymaking that could present financial conflicts of interest.
