An arbitration provision that purchasers must accept in order to set up the devices after purchase is enforceable, Judge P. Casey Pitts of the US District Court for the Northern District of California said.
The court rejected the plaintiffs’ argument that the provision is unconscionable.
Under California law, plaintiffs must show both procedural and substantive unconscionability, Pitts said.
