Nutricia Gets New Classification for Imported ‘Medical Foods’

Nutricia North America Inc. moved one step closer to getting five products it imports classified as “pharmaceutical products” that won’t be subjected to tariffs.

US Customs and Border Protection classified the products as “miscellaneous edible preparations” under the Harmonized Tariff Schedule of the US, which made them subject to a 6.4% duty in 2014. The Court of International Trade upheld that decision.

There is no dispute that the products are medical foods, Judge Richard G. Taranto said Monday in an opinion for the US Court of Appeals for the Federal Circuit. The issue was whether they were “medicaments,” and Nutricia’s ...
