A Florida assisted living facility lost its bid Monday for the Eleventh Circuit to rehear a dispute over whether a case over a resident’s 2020 death tied to Covid-19 belongs in federal court.
The order from the US Court of Appeals for the Eleventh Circuit rejects JSMGV Management Co. and GVDB Operations LLC’s request for a three-judge panel and the full court to take another look at a split panel decision to send the dispute back to Florida state court.
