Nurse Practitioner Misclassification Primes DOL Overtime Win

A Philadelphia home health company could be on the hook for millions of dollars for misclassifying licensed nurse practitioners as independent contractors, the US District Court for the Eastern District of Pennsylvania ruled Friday.

The Department of Labor correctly argued that Amazing Care Home Healthcare Services improperly classified nurses as independent contractors and also issued 1099s to unskilled home health aides once they reached high levels of overtime hours to avoid paying higher salaries, Judge Timothy J. Savage ruled.
