Nun Advances Religious Bias Claim Against School Founded by Nuns

Buffalo’s D’Youville University may have to face at trial in a case brought by a former employee who says she lost her part-time role as the school’s archivist because she is a nun.

The ruling Monday by the US District Court for the Western District of New York found that Nancy Kaczmarek raised fact issues on part of her religious discrimination claim against the university—formerly known as D’Youville College—even though the school is affiliated with the Catholic Church and was founded by the Grey Nuns of the Sacred Heart, the Roman Catholic order of which Kaczmarek is a member.
