NTT Applicants Advance Race Bias Class Suit Over Criminal Checks

NTT Data Inc. must face revived claims by Black job seekers who say its policy of not hiring applicants with criminal records has a disparate impact based on race.

The workers added sufficient details to their statistical allegations to cure the deficiencies found in their prior pleadings, the US District Court of the Western District of New York said Monday. They did so in part by following suggestions of the US Court of Appeals for the Second Circuit when it agreed earlier in the case that the putative class action failed to plausibly plead disparate impact bias, the court said. ...
