Credit card payment processor NRS Pay lost its early bid to deny class certification in a lawsuit alleging it made telemarketing calls in violation of the Telephone Consumer Protection Act.
Lead plaintiff Rashad Walston was an adequate class representative because he possessed the same interest as the other class members, suffered the same alleged injury, and was likely to get the same reward, Judge Sunil R. Harjani of the US District Court for the Northern District of Illinois said Wednesday. The judge denied NRS Pay’s motion to deny class certification, allowing class discovery to proceed.
