North Carolina’s treasurer and state employee health plan administrator are barred from enforcing the plan’s exclusion of payment for gender-conforming health care, a federal court in the state said, correcting an earlier opinion.
The US District Court for the Middle District of North Carolina held in June that the North Carolina State Health Plan for Teachers and State Employees’ refusal to pay for care “leading to or in connection with sex changes or modifications” discriminates against transgender employees and their dependents on the basis of sex and transgender status in violation of the Equal Protection Clause and Title VII.
