Department store chain Belk Inc. negligently failed to protect the personal information of thousands of consumers and employees that was exposed in a May data breach, a proposed federal class action said.
Lead plaintiff Andrew Davis, a former Belk employee, alleged the company breached its duties under common law, contract law, industry standards, and the Federal Trade Commission Act to implement reasonable and adequate data-security measures and provide timely notice of the incident.
