The phrase “2X” commonly means “two times,” which makes Nordic Naturals “Ultimate Omega 2X” fish oil label deceptive, a California federal judge said in advancing a consumer protection suit.
Lead plaintiff Cheryl Caldwell said the “2X” on the front of the package makes consumers think the product has twice as much omega-3 per serving as the Nordic Naturals Inc. product named “Ultimate Omega.” But the math doesn’t work, she alleged in a proposed class suit in the US District Court for the Northern District of California.
