Progressive Rebuffed in Claim Processors’ Overtime Wage Lawsuit

Progressive Casualty Insurance Co. should have to continue litigating allegations it owes workers overtime pay, a federal magistrate judge in Florida said, recommending the district court reject the company’s administrative exemption argument.

The insurance company’s summary judgment motion should be denied because a jury should decide if the workers exercised enough discretion and independent judgment to qualify for an exemption from the Fair Labor Standards Act’s overtime requirements, the US District Court for the Middle District of Florida magistrate judge’s report said.
