A man’s year-long detention while the federal government sought to remove him from the US did not violate his right to due process under the Constitution, a federal appeals court said Tuesday.
The US Court of Appeals for the Eighth Circuit reversed a district court’s decision granting Nyynkpao Banyee’s habeas corpus petition.
“Due process imposes no time limit on detention pending deportation,” Judge David R. Stras wrote.
