NJ Court Upholds State’s Gender Identity-Based Sex Ed Program

New Jersey education regulators can break public school sexual education courses into classes based on gender identity, a state appeals court ruled Tuesday.

The decision upholds a 2023 update to state education equity rules which seek to align school district policies with the state’s expansive Law Against Discrimination.

The update added a new definition for gender identity and said districts are allowed to conduct separate classes for sexual education, with students separated based on gender identity rather than sex.
