New Jersey police told state appellate judges Tuesday that law enforcement can plant a GPS device on a car in a suspect’s driveway because access by delivery drivers remove residents’ privacy protections.
While the law gives police the right to access a resident’s front door by walking up their driveway, two Superior Court Appellate Division judges pushed back against the idea that companies’ limited commercial licenses give officers broader entitlement to an entire driveway. They questioned whether warrants must specifically call out this access to protect against unlawful searches and seizures.
