Nissan Loses Bid to Recoup Jury Award From Brake Parts Supplier

Nissan North America Inc. isn’t entitled to indemnification from its brake parts supplier for a multi-million dollar jury award in a case where the braking system on a Nissan Infiniti was found to be a substantial factor in causing a crash that killed three people, the Sixth Circuit ruled.

The contract between Nissan and Continental Automotive Systems Inc. requires that Continental’s parts were defective and caused personal injury before the supplier could be held liable for Nissan’s costs, the appeals court said.
