Nissan Gets Quick Class Status Appeal in Exploding Sunroof Case

Nissan North America Inc. may quickly appeal a decision that granted class certification in litigation by drivers who alleged the automaker failed to disclose that panoramic sunroofs on certain vehicles are shatter-prone, the Ninth Circuit said.

Drivers said Nissan violated state consumer protection laws by concealing the alleged design flaw in certain Nissan and Infiniti vehicles. They also said Nissan violated implied warranties of merchantability because the alleged sunroof defect rendered the vehicles unfit for ordinary use.
