Nissan, Cummins Trim Claims Over Allegedly Defective Fuel Pump

Nissan North America Inc. and engine manufacturer Cummins Inc. trimmed proposed consumer class claims in a suit alleging Nissan’s sale of Titan XD pickup trucks, manufactured from 2016 through 2019, contained diesel engines with defective fuel pumps.

Nissan and Cummins filed separate motions to dismiss the class claims from multiple states, both of which, were granted in part and denied in part.

Nissan won the dismissal of a Florida resident’s claim of fraudulent omission under the state’s Deceptive and Unfair Trade Practices Act, brought on behalf of himself and others in the state who purchased or leased the vehicle. The ...
