Nissan Beats Suit Over California Emissions Warranty Coverage

A prior class action settlement bars claims that Nissan North America Inc. fails to properly pay for repair and replacement of transmissions that should be covered under a California warranty for vehicles sold as environmentally friendly.

Maria Velarde’s proposed class action claims are precluded because she could have presented them to the US District Court for the Middle District of Tennessee, which approved a class action settlement on March 10, 2020, Judge John A. Mendez of the US District Court for the Eastern District of California ruled Monday.
