Nippon Kaiji Kyokai Must Face Indian Worker’s Pay Bias Claim

A jury must decide whether a Japanese ship classification organization paid a New Orleans-based surveyor less than his Korean and Japanese peers because of his Indian national origin, a federal judge ruled.

Nippon Kaiji Kyokai Corp. was wrong that Atul Pachori didn’t establish a prima face case of compensation discrimination under Title VII of the 1964 Civil Rights Act and Louisiana law by just pointing to his lower base pay, the U.S. District Court for the Eastern District of Louisiana said.

And the nonprofit organization waited too long to offer a nondiscriminatory explanation for the pay disparity, the court said. ...
